SSA Overpayment Recovery Withholding Rules Changes 2025
The SSA can recover the overpaid benefits via repayment plans, monthly benefits reduction, online at pay.gov.
- If a beneficiary thinks that the benefit amount was overpaid then they can pay the full amount through pay.gov.
- If a beneficiary does not get SSA payments now then they can set up a repayment plan so that the overpaid benefits can be settled. For this option, beneficiaries can connect at +1 800 722 1213 or TTY at +1 800 325 0778.
- If a beneficiary gets the SSA benefits now then they can choose to replay from their current benefits. As of new rules from 27 March, 2025, the 100% OASDI (Retirement, Survivors, Disability Benefit) would be withheld. The 10% SSI would be withheld. These rules apply to the overpayments on or after 27th March, 2025. Beneficiaries can fill out Form SSA-634 if they can’t afford to repay from 100% benefit and want to lower the withholding rate.
- If a beneficiary thinks that they are not at fault for overpaid benefits and now they are not in a situation to pay back then they can fill in Form SSA-632-BK. The beneficiary must not fill this form if the overpayment amount is $2,000 or below. Instead they can connect at +1 800 722 1213.
- If a beneficiary disagrees with the overpayment amount or thinks that there is no overpayment and wants to appeal then they can fill in Form SSA-561.

If SSA believes you were overpaid then they will notify you officially with a letter.
SSA Sends A Letter: SSA will give a letter to the beneficiary regarding the overpayment, its amount, reason and how they can recover the overpaid benefits. The letter will usually state that repayment should be completed before 30 days.
30 Days Response Window: Beneficiaries have 30 days to take any action. The action might be paying off the overpaid benefit, waiver, reconsideration or appeal.
Request Waiver, Reconsideration or Appeal: If a beneficiary thinks that overpayment was not their fault or that it was miscalculated or that repayment would cause hardship, then they have options to request waiver reconsideration or appeal within thirty days only.
